Cloudtheapp Website and Software Product Visitors
Like most website and software product operators, Cloudtheapp collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Cloudtheapp’s purpose in collecting non-personally identifying information is to better understand how Cloudtheapp’s visitors use its website and products. From time to time, Cloudtheapp may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website and products.
Cloudtheapp also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users and for users leaving comments on https://www.cloudtheapp.com/ blog posts. Cloudtheapp only discloses logged in user and commenter IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below.
Gathering of Personally-Identifying Information
Certain visitors to Cloudtheapp’s websites and software products choose to interact with Cloudtheapp in ways that require Cloudtheapp to gather personally-identifying information. The amount and type of information that Cloudtheapp gathers depends on the nature of the interaction. When you visit our websites, register for the Platform services, or request more information about Cloudtheapp Services, we may request that you provide Personal Data about yourself, and we also collect navigational information. In some cases, if you do not provide enough Personal Data, we may not be able to provide all of our available products and services. We may collects Personal Data such as name, title, phone number, email address, mailing address, and IP address. Additionally, when you sign up for a Cloudtheapp’s paid services, we collect your billing information, including your credit card number, expiration date, and billing address. Cloudtheapp may also receive Personal Data from its business partners based on your consent.

We share the personal data that customers enter or upload into our website, software products, forms, and Cloud Services as directed by the customers and to comply with applicable legal requirements.
We may share the data we collect with our third-party service providers that perform services on our behalf to provide services that customers have requested but only to the extent needed to enable them to provide customers with such services.
Data such as name, email, phone number, and picture can be shown to other users within Cloudtheapp’s network as well as admins of teams you are a member of or you request to join.
If you choose to comment on an article via our blog, we may display your name publicly along with your comment.

California Privacy Rights

You must clearly state the nature of your California Privacy Rights request and provide sufficient information for us to process your request; at a minimum your name, email address, and California postal address.

Cloudtheapp products and Services are available globally, we may process information in many countries, and therefore your Personal Data may be transferred to servers located in different geographical areas. We may transfer your personal data to countries other than the country in which the data was originally collected, including the United States. The countries to which we transfer personal information may not have the same data protection laws as the country in which you initially provided the personal information.
Do Not Track Response
Certain web browsers may allow you to enable a “do not track” option that sends signals to the websites you visit indicating that you do not want your online activities tracked. However, some browsers with the “do not track” option selected may still accept cookies. Because there is no industry standard for how companies should respond to “do not track” signal, we do not respond to “do not track” signals at this time. If we do so in the future, we will modify this statement accordingly.
You shall indemnify and hold harmless Cloudtheapp Inc. (and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees) from any and all claims, damages, liabilities, costs, and expenses (including, but not limited to, reasonable attorneys’ fees and all related costs and expenses) incurred as a result of any claim, judgment, or adjudication against Cloudtheapp Inc.
Governing Law; Jurisdiction and Venue
This Agreement shall be governed by, and construed in accordance with, the laws of the State of Delaware without regard to its rules of conflict of laws. The parties hereto hereby irrevocably and unconditionally consent to and submit to the exclusive jurisdiction of the courts of the State of Delaware and of the United States of America located in such state (the “Delaware Courts”) for any litigation arising out of or relating to this Agreement and the transactions contemplated hereby (and agree not to commence any litigation relating thereto except in such courts), waive any objection to the laying of venue of any such litigation in the Delaware Courts and agree not to plead or claim in any Delaware Court that such litigation brought therein has been brought in any inconvenient forum.
If any provision of this agreement shall be declared by any court of competent jurisdiction to be illegal, void, or unenforceable, the other provisions shall not be affected but shall remain in full force and effect.
